Artwork Is Handmade

Every piece of artwork is created by hand. Small variations, textures, brushstrokes, and natural imperfections are part of the artistic process and should be expected. No two pieces are exactly alike.

Original Artwork Sales

All original artwork is sold as described and photographed. While we strive to accurately represent colors and details, actual colors may vary slightly due to screen settings, lighting conditions, and display devices.

Commissioned Artwork

Commissioned artwork is a collaborative creative process. Clients are encouraged to provide inspiration, preferences, dimensions, color palettes, and other relevant details before work begins. By purchasing a commission, you acknowledge that artistic interpretation is part of the creative process.

Deposits and Payments

By Kleine LLC may require a deposit before beginning commissioned work. Deposits are non-refundable once work has begun. Final artwork will not be shipped or delivered until all outstanding balances have been paid in full.

Revisions

Reasonable revisions may be offered at the artist’s discretion. Requests that substantially alter the original project scope may require additional fees.

Cancellations

Original artwork purchases may only be canceled before shipment. Commission orders may be canceled before work begins. Once a commissioned piece is in progress, deposits and completed work are non-refundable.

Shipping and Delivery

We take great care in packaging artwork for shipment. Once artwork has been transferred to the shipping carrier, delivery timelines are outside our control. Customers are responsible for providing accurate shipping information. By Kleine LLC is not responsible for delays caused by shipping carriers, weather events, customs processing, or circumstances beyond our control.

Damaged Shipments

If artwork arrives damaged, customers must notify us within seven (7) days of delivery and provide photographs of both the packaging and damaged artwork. Claims submitted after this period may not be eligible for replacement or reimbursement.

Copyright and Intellectual Property

All artwork, images, photographs, website content, designs, and creative materials remain the intellectual property of By Kleine LLC unless otherwise agreed in writing. The purchase of artwork does not transfer copyright ownership. Customers may display purchased artwork for personal use but may not reproduce, distribute, sell prints of, license, modify, or commercially exploit the artwork without prior written permission.

Portfolio and Promotional Use

By Kleine LLC reserves the right to photograph, display, and promote completed artwork, including commissioned pieces, on its website, social media channels, marketing materials, and portfolio unless otherwise agreed in writing before work begins.

Limitation of Liability

To the fullest extent permitted by law, By Kleine LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of this website, the purchase of artwork, commissioned artwork, shipping delays, or any related transaction. In all circumstances, the maximum liability of By Kleine LLC shall not exceed the amount paid by the customer for the applicable artwork or service.

No Guarantees

Artwork is inherently subjective. While we strive to create meaningful and beautiful pieces, we cannot guarantee personal preferences, emotional responses, investment value, future appreciation, or outcomes beyond the scope of the purchased artwork.

Website Use

You agree not to misuse this website, attempt unauthorized access, interfere with website functionality, or violate applicable laws while using the site.

Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of the state in which By Kleine LLC is organized, without regard to conflict of law principles.
